Terms of Service

Article 1 (Application)
- These Terms set out the conditions for use of the application "FocusGoal" (the "App"; the services provided through the App are the "Service") provided by FreEase, Inc. (the "Company"), between the Company and every user of the Service (each a "User").
- By using the Service, the User is deemed to have agreed to these Terms and to the Company's Privacy Policy.
- The agreement based on these Terms is concluded between the User and the Company; Apple Inc. and its subsidiaries ("Apple") are not parties to this agreement.
- Responsibility for the App and the content of the Service lies with the Company, not with Apple.
Article 2 (Definitions)
The terms used in these Terms are defined as follows.
- "Blocking settings" means the settings a User configures through the Service regarding daily smartphone usage time and app usage restrictions.
- "Goal settings" means the settings a User configures through the Service regarding personal goals and the plans to achieve them.
- "Subscription" means a recurring subscription to a paid plan of the Service.
Article 3 (Content of the Service)
- The Service is an application that helps Users manage their smartphone usage time and achieve their goals.
- Users can configure app usage restrictions through Apple's Screen Time API (Family Controls / DeviceActivity / ManagedSettings).
- The Service requires no account registration or authentication, and data entered by the User is, as a rule, stored only on the device.
Article 4 (License)
- The Company grants the User a limited, non-exclusive, non-transferable, and non-sublicensable license to use the App in accordance with the conditions set out in these Terms.
- Use of the App is limited to Apple-branded devices that the User owns or controls and that are permitted by the usage rules set out in the Apple Media Services Terms and Conditions.
- The license under these Terms is a grant of use, not a sale of the App; intellectual property rights and all other rights relating to the App belong to the Company or the rightful rights holders.
- In using the App, the User shall comply with the Apple Media Services Terms and Conditions and all other applicable laws and regulations.
Article 5 (Fees and Payment)
- The fees for the paid plans of the Service are as follows.

- Payment is made through Apple's In-App Purchase. Payment information is managed by Apple and is never obtained by the Company.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- The annual plan may include a free trial period upon initial subscription. Billing begins automatically once the free trial period ends.
Article 6 (Consent to Data Collection and Use)
- By using the Service, the User consents to the collection and use of data described in the Company's Privacy Policy.
- The Service collects analytics data (such as how onboarding is used) and transmits it to a third-party analytics service in order to improve the quality of the Service. For details of the data collected, please see the Privacy Policy.
- The Service may request tracking permission through Apple's AppTrackingTransparency framework. Granting tracking permission is optional, and declining it does not limit the features of the Service.
Article 7 (Use of Third-Party Services)
- The Service uses the following third-party services. In using the Service, the User also agrees to the terms of use and privacy policies of these third-party services.
- Mixpanel (analytics): used to analyze the onboarding funnel and improve the Service.

- RevenueCat (purchase management): used to manage in-app purchases and subscriptions.

- Apple (platform and payments): processes in-app purchase payments and provides the Screen Time API.
- Mixpanel (analytics): used to analyze the onboarding funnel and improve the Service.
- In using the App, the User shall comply with the applicable conditions of use of third-party services. In particular, use on the Apple platform is subject to Apple's terms of use and the usage rules set out in the Apple Media Services Terms and Conditions.
- The Company bears no responsibility for any limitation or suspension of the Service caused by failures, specification changes, or discontinuation of third-party services.
Article 8 (Prohibited Conduct)
In using the Service, the User shall not engage in any of the following.
- Conduct that violates laws, regulations, or public order and morals
- Conduct related to criminal activity
- Conduct that destroys or interferes with the functioning of the servers or networks of the Service
- Conduct that may interfere with the operation of the Service
- Collecting or accumulating personal information about other Users
- Unauthorized access, or attempts thereof
- Impersonating another User
- Directly or indirectly providing benefits to antisocial forces in connection with the Service
- Reverse engineering, decompiling, disassembling, or similar acts with respect to the Service
- Any other conduct that the Company deems inappropriate
Article 9 (Export Controls and Legal Compliance)
- The User represents and warrants that they are not located in a country or region to which export or re-export is prohibited or restricted under U.S. or other applicable laws.
- The User represents and warrants that they are not listed on the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) list of sanctioned parties or any other applicable sanctions list.
- The User shall not use the App in violation of applicable export control or sanctions laws.
Article 10 (Suspension of the Service)
- The Company may suspend or interrupt all or part of the Service without prior notice to Users if it determines that any of the following applies.
- Maintenance, inspection, or updating of the computer systems used for the Service
- Provision of the Service becomes difficult due to force majeure such as earthquake, lightning, fire, power outage, or natural disaster
- Computers or communication lines stop due to an accident
- A failure occurs in Apple's services or APIs
- A failure occurs in a third-party service (Mixpanel, RevenueCat, etc.)
- The Company otherwise determines that provision of the Service is difficult
- The Company bears no responsibility whatsoever for any disadvantage or damage suffered by a User or a third party as a result of the suspension or interruption of the Service.
Article 11 (Usage Restrictions and Termination)
- The Company may restrict a User's use of all or part of the Service without prior notice if any of the following applies to that User.
- The User has breached any provision of these Terms
- The Company otherwise determines that the User's use of the Service is not appropriate
- The Company bears no responsibility for any damage incurred by a User as a result of actions taken by the Company under this Article.
Article 12 (Withdrawal)
A User may end their use of the Service at any time by deleting the App from their device. Note that if you are on a paid plan, deleting the App alone does not cancel the subscription. Please cancel the subscription from Apple's Settings app.
Article 13 (Disclaimer of Warranties and Limitation of Liability)
- The Company makes no warranty, express or implied, that the Service is free from de facto or legal defects (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or security, as well as errors, bugs, and infringement of rights).
- The Company bears no responsibility whatsoever for any damage incurred by a User arising from the Service. However, this disclaimer does not apply where the agreement between the Company and the User concerning the Service (including these Terms) constitutes a consumer contract under Japan's Consumer Contract Act.
- Even in the case described in the proviso to the preceding paragraph, the Company bears no responsibility for damage arising from special circumstances (including where the Company or the User foresaw or could have foreseen the occurrence of the damage) among the damage incurred by a User due to the Company's negligence (excluding gross negligence) in nonperformance of obligations or tort.
- The Company bears no responsibility for any limitation of the Service arising from specification changes or failures of Apple's Screen Time API or the Family Controls framework.
- Where a warranty exists that cannot be disclaimed under applicable law, the Company, and not Apple, is responsible for that warranty.
- Apple bears no warranty obligation whatsoever with respect to the App. Even if warranty liability is imposed on Apple under applicable law, Apple's liability is limited to the minimum extent permitted by that law.
Article 14 (Maintenance and Support)
- The Company is solely responsible for maintenance and support relating to the App and the Service.
- Apple has no obligation whatsoever to provide maintenance or support for the App.
Article 15 (Product Claims)
- The Company is responsible for claims, complaints, and demands from Users or third parties relating to the App or the Service (including product liability, legal compliance, consumer protection, privacy, and any other claims relating to the App).
- Apple bears no responsibility whatsoever for the claims described in the preceding paragraph relating to the App or the Service.
Article 16 (Intellectual Property Claims)
- If a claim is made that the App or the Service infringes a third party's intellectual property rights, the Company shall handle that claim at its own responsibility and expense.
- Apple bears no responsibility whatsoever for claims relating to intellectual property infringement concerning the App or the Service.
Article 17 (Changes to the Service)
The Company may change the content of the Service or discontinue providing the Service without notice to Users, and bears no responsibility whatsoever for any damage incurred by Users as a result.
Article 18 (Changes to These Terms)
- The Company may change these Terms at any time without notice to Users where it determines this to be necessary.
- The revised Terms take effect when published on this page. If a User begins using the Service after a change to these Terms, that User is deemed to have agreed to the revised Terms.
Article 19 (Handling of Personal Information)
The Company shall appropriately handle personal information obtained through use of the Service in accordance with the Company's Privacy Policy.
Article 20 (Notices and Communications)
Notices and communications between a User and the Company shall be made in the manner determined by the Company. The Company may give notice by posting within the App or on this website.
Article 21 (Prohibition of Assignment)
A User may not assign to a third party, or offer as security, their position under the usage agreement or any rights or obligations under these Terms without the prior written consent of the Company.
Article 22 (Apple as a Third-Party Beneficiary)
- Apple and its subsidiaries are third-party beneficiaries of these Terms.
- Upon the User's acceptance of these Terms, Apple acquires the right, as a third-party beneficiary, to enforce these Terms against the User.
Article 23 (Governing Law and Jurisdiction)
- These Terms shall be interpreted in accordance with the laws of Japan.
- In the event of a dispute concerning the Service, the Tokyo District Court shall have exclusive jurisdiction of the first instance.
